Seeing as these are paid accounts and they have a certain contractual duty, it seems to me he should be able to get a big settlement for their disruption of his service and for the destruction of his data, especially if they cannot or will not provide him with a full backup.

To retrieve that local file, a user would need the Multiaddr. Essentially, the protocol to the ipfs server on his PC. Or whatever computer he's using. Other wise it needs to be distributed. Not everyone wants to share huge files, so they can get paid through filecoin. Probably other ways too. That's not a requirement, it's just the scheme they devised to monetize the ipfs network.
Just in case you didn't realize it, we are at war. Always assume your accounts will be nuked. Always have 10 different backups on other platforms. Always keep a hard copy in the physical world on paper in a fireproof safe.
